Na última quarta-feira (31), o Tribunal de Justiça da Bahia (TJ-BA) reconheceu que o território de comunidades tradicionais de fundo de pasto de Areia Grande, em Casa Nova (BA), é composto por terras devolutas do estado da Bahia e, portanto, não pertence ao Banco do Brasil, que reivindicava ser proprietário das terras. Há mais de 15 anos, o Banco e dois empresários vinham buscando judicialmente a expulsão de 400 famílias de seu território.
André Sacramento, advogado da Associação dos Advogados/as de Trabalhadores/as Rurais (AATR) que acompanha o caso, explica que essa decisão do TJ-BA é uma vitória para as comunidades, pois reconhece que a ação se trata de grilagem de terras. "Foi um processo longo, de muitas dificuldades, quando nós da AATR assumimos o processo já havia uma sentença de expulsão dos trabalhadores em favor do Banco do Brasil, nós alegamos a grilagem dessas terras, que eram terras que nunca tinham pertencido a fazendas, mas que se tratavam de terras devolutas. Com essa decisão, o TJ-BA nos surpreendeu positivamente reconhecendo que se tratam de terras griladas que não poderiam ter sido passadas para o Banco do Brasil, nem ser alvo da ação de despejo", afirmou o advogado.
Para Zacarias Rocha, do território de Areia Grande, essa vitória judicial serve de ânimo para a população local continuar na luta por seu território e também para fortalecer outras comunidades que estão passando por situação semelhante. "Isso significa a reafirmação das comunidades de Areia Grande enquanto detentoras do território. As comunidades vêm há séculos fazendo a luta para permanência no seu território, quando Areia Grande ganha, outras comunidades também ganham com isso, porque é o modo de vida desses povos. E também não significa dizer que com essa vitória a luta deva parar", comentou Rocha.
Histórico do conflito
A área em litígio, o território de Areia Grande, é composto pelas comunidades Melancia, Riacho Grande, Salinas da Brinca, Jurema, Tanquinho, Ladeira Grande, Lagoado, Lagedo, Lagoinha, Pedra do Batista e Pilão. Desde a segunda metade do século XIX, essas comunidades estão no território, vivendo da criação à solta de caprinos e extrativismo.
Na final da década de 1970, Areia Grande foi alvo de um processo escandaloso de grilagem em benefício da empresa Agroindustrial Camaragibe S.A, que acessando recursos do Proálcool, adquiriu "títulos de posses" na área e os registrou no Cartório de Registro de Imóveis de Casa Nova como se fossem propriedade.
Além da fraude no registro, a empresa abandonou o projeto de produção de álcool biodiesel e apropriou-se do financiamento público, deixando uma dívida milionária com o Banco do Brasil, no contexto do chamado "Escândalo da Mandioca", de repercussão nacional. Como forma de pagamento da dívida, o Banco do Brasil adquiriu o direito sobre os títulos supostamente de propriedade registrados pela empresa nas terras de Areia Grande, e, em 2004, os transferiu para os empresários Alberto Martins Pires Matos e Carlos Nisan Lima Silva.
Em 2006, esses empresários ingressaram com uma ação judicial contra 11 moradores de Areia Grande, acusando-os de invasores e requerendo a imissão daqueles na posse da área, o que foi aprovado pelo juiz de direito de Casa Nova, sem sequer ouvir o Ministério Público.
O cumprimento da decisão causou amplo clamor social, quando no dia 06.03.2008, a região de Areia Grande reviveu situação de terror. Policiais e prepostos dos empresários invadiram a área ocupada secularmente pelas comunidades, destruíram casas, chiqueiros, currais, roçados, árvores centenárias da caatinga, milhares de metros de cercados, levando a prejuízos calculados em mais de um milhão de reais. As ameaças armadas chegaram ao extremo, culminando, em 2009, no assassinato do trabalhador rural José Campos Braga (Zé de Antero), crime que continua impune até hoje.

Na manhã do dia 31/05, representantes de povos e comunidades tradicionais do Cerrado dos estados da Bahia, Maranhão, Piauí, Goiás, Tocantins, Mato Grosso e Mato Grosso do Sul participaram de uma oficina sobre como denunciar contaminações causadas por agrotóxicos. A oficina foi ministrada por Naiara Bittencourt, advogada da Terra de Direitos e da Campanha Permanente Contra os Agrotóxicos e Pela Vida. Foram abordadas estratégias de registro de denúncias, produção e armazenamento de provas e canais de formalização dos registros.
Entre as situações e fatos passíveis de serem denunciados, Naiara apontou o envenenamento de pessoas e animais, alergias, coceiras, mortes de animais, contaminação de trabalhadores e o descarte inadequado de embalagens de agrotóxicos.
"É importante ter parcerias com a mídia, entidades e movimentos sociais que possam levar adiante os registros das violações. Muitas vezes os órgãos públicos não vão encaminhar as denúncias por vontade própria, seja por pressão política, econômica, seja por falta de estrutura ou por medo dos servidores. Por isso é preciso estabelecer parcerias para driblar essas dificuldades. Os agrotóxicos são o eixo do agronegócio, e o agronegócio é o eixo do capitalismo no Brasil. Então, o agrotóxico está no eixo do capitalismo no país", afirmou Naiara. A advogada apresentou às participantes um página específica do site da Campanha Permanente Contra os Agrotóxicos que condensa as dicas para realizar denúncias com segurança e efetividade.
Luta a partir de resultados de dossiê
No período da tarde, os participantes discutiram ações de articulação, formação, incidência e comunicação na luta contra os agrotóxicos a partir dos resultados da publicação "Vivendo em territórios contaminados: um dossiê sobre agrotóxicos nas águas do Cerrado", lançada dia 30/05.
Entre as estratégias de articulação apresentadas, foram sugeridas ações de fortalecimento de redes, ações de vigilância popular em saúde e parcerias com instituições de pesquisa e divulgação científica. No campo da formação, foram apontadas como estratégias a inclusão do tema agrotóxicos em escolas do campo, o fortalecimento da formação de base com professores, profissionais da saúde e sindicatos, a realização de oficinas nas comunidades e seminários estaduais para debater o assunto de maneira mais ampla.
Na comunicação, os grupos sugeriram a produção de materiais pedagógicos, panfletos, cards, divulgação de tecnologias e informações sobre produções agroecológicas e o monitoramento e denúncias sobre a contaminação por agrotóxicos. No campo da incidência, foi sugerida a realização de audiência pública para pautar a criação de projetos de lei que protejam os povos e comunidades da contaminação, que proíbam a pulverização aérea e a isenção de impostos para agrotóxicos.
Recomendações ao poder público
No fim do dia, a atividade de encerramento focou na construção de recomendações gerais aos órgãos responsáveis e ao Congresso Nacional no sentido do combate à contaminação dos povos e comunidades pelo agrotóxico das monoculturas.
Mariana Pontes, da secretaria executiva da Campanha Nacional em Defesa do Cerrado, e Juliana Acosta, representante da Campanha Permanente Contra os Agrotóxicos e Pela Vida, expuseram e debateram as recomendações construídas ao longo de processos coletivos pelas duas campanhas. Esta última atividade teve como objetivo preparar a Audiência Pública na Câmara dos Deputados realizada na manhã de hoje.
As três atividades fizeram parte do "Seminário de Convergência: Agrotóxicos como armas químicas nos territórios do Cerrado", realizado em Brasília entre os dias 30 e 31 de maio e 1 de junho pela Campanha Nacional em Defesa do Cerrado, Campanha Permanente Contra os Agrotóxicos e Pela Vida e pela Comissão Pastoral da Terra (CPT).

Na segunda-feira (29), representantes de movimentos populares, organizações e de comunidades tradicionais participaram de reunião no Ministério do Meio Ambiente e Mudança do Clima para denunciar as violações por agrotóxicos no Cerrado e solicitar providências diante da contaminação dos territórios e intoxicação das populações.
Na ocasião, pela secretaria-executiva da Campanha Nacional em Defesa do Cerrado, Mariana Pontes, informou que uma pesquisa realizada, entre 2021 e 2023, de análise de contaminação das águas por agrotóxicos em sete comunidades tradicionais, nos estados da Bahia, Goiás, Mato Grosso, Mato Grosso do Sul, Maranhão, Piauí e Tocantins, identificou “graves evidências de contaminação nas águas dos territórios”.
A pesquisa revelou 13 Ingredientes Ativos (IAs), todos com uso autorizado na soja. Cerca de 50% dos agrotóxicos encontrados nas águas dos povos e comunidades tradicionais estão banidos na União Europeia, devido ao alto impacto na saúde e no ambiente. As análises sobre os riscos provocados por esses agentes apontam para doenças irreversíveis, como câncer, males decorrentes de desregulação endócrina, como diabetes e infartos, e para a extinção de espécies fundamentais para a manutenção dos ciclos socioecológicos, como é o caso das abelhas e insetos responsáveis pela polinização das plantas, sejam elas nativas ou cultivadas.
A representante da Comissão Pastoral da Terra (CPT) e da coordenação executiva da Campanha do Cerrado, Valéria Santos, disse que as comunidades já estão cansadas de fazer denúncias das violações por agrotóxicos. “Se a gente empilhar os boletins de ocorrências com as denúncias a gente constrói um prédio”.
Para ela, é fundamental que o Ministério implemente um canal específico para denúncias sobre contaminação por uso e pulverização dos agrotóxicos e outras violações, construindo e divulgando massivamente um protocolo público para a realização das referidas denúncias. “O que o agronegócio tem feito é a expulsão das populações de seus territórios, e se ainda existe cerrado é porque existem as comunidades tradicionais que resistem”, enfatizou.

Da comunidade de Santa Helena, em Goiás, o agricultor e integrante do Movimento dos Trabalhadores Rurais Sem Terra (MST), Wilmar Lacerda, ressaltou que devido ao uso indiscriminado de venenos na região, a produção de alimentos agroecológicos tem sido inviabilizada pela exposição indireta de agrotóxicos.
“A nossa água está contaminada, a gente não consegue avançar na produção de alimentos agroecológicos e orgânicos. Já perdemos plantações inteiras por conta da pulverização aérea, nossos animais já estão nascendo doentes, o câncer está se alastrando na população. O agrotóxico mata e ninguém está vendo”, denunciou o agricultor.
Para Juliana Acosta, da Campanha Permanente Contra os Agrotóxicos e Pela Vida, “nós vivemos uma contradição muito grande”. Ela apontou que muitos dos ingredientes ativos liberados no Brasil são banidos em outros países, além disso, o limite de resíduos de agrotóxicos pode chegar a 5 mil vezes mais do que na União Europeia, por exemplo.
Diante do avanço do agronegócio e do uso avassalador de agrotóxicos, a Campanha do Cerrado protocolou um ofício com uma série de recomendações, dentre elas, o oficiamento às Secretarias Estaduais e Municipais de Saúde dos Estados da Bahia (município Formosa do Rio Preto), Goiás (município Santa Helena de Goiás), Mato Grosso (município Nossa Senhora do Livramento), Mato Grosso do Sul (município Sidrolândia), Maranhão (município Parnarama), Piauí (município Santa Filomena) e Tocantins (município Campos Lindos), para que seja realizada uma força tarefa de atendimento médico aos integrantes das comunidades, de modo a investigar e identificar intoxicações por agrotóxicos.
Ainda articular a revisão dos parâmetros de presença de resíduos de agrotóxicos na água, no procedimento de avaliação e controle da potabilidade da água para consumo, de modo a ampliar o rol de agrotóxicos analisados na avaliação de potabilidade, adotar os limites máximos definidos na Comunidade Europeia para agrotóxicos em água, conforme recomenda o Parecer Técnico do GT de Agrotóxicos da Fundação Oswaldo Cruz – Fiocruz, e garantir que as fontes alternativas de águas, sobretudo as fontes comunitárias, sejam também avaliadas, bem como, articular a proibição da pulverização aérea de agrotóxicos em todo o território nacional.
A diretora substituta do Departamento de Políticas de Gestão Ambiental Rural do MMA, Fádia Rebouças, recebeu o ofício e se colocou à disposição para levar as informações para a ministra Marina Silva.

Nos dias 20 e 21 de maio, mais de quarenta mulheres diocesanas se reuniram para participar do Encontro Estadual do Coletivo de Mulheres da Comissão Pastoral da Terra do Rio Grande do Sul (CPT/RS). O Encontro foi realizado na Escola Alternativa da Juventude Rural - Escajur, em Passo Fundo/RS, e teve como tema central o “Autocuidado e a Organização do Coletivo de Mulheres da CPT”.
Por meio de místicas e rodas de conversa, o evento promoveu reflexões importantes a respeito da memória e do fortalecimento da luta de mulheres que são mártires por sua trajetória na defesa de direitos, como Roseli Nunes, Irmã Dorothy, Marielle Franco e Margarida Alves.
O Encontro contou, ainda, com o momento de estudo bíblico "Mulheres na Bíblia", com reflexões sobre violências e resistências. Além disso, elas também se aprofundaram no debate sobre a atuação feminina no trabalho, na política e em suas lutas históricas e cotidianas.

O Brasil não é mais o país do futebol, como convencionou-se dizer. Em realidade, o nosso país pode ser considerado o campeão dos agrotóxicos, do veneno e da morte da sociobiodiversidade. Essa mudança aconteceu não somente pelos recentes fracassos da seleção brasileira nas últimas copas do mundo, mas por fatores como a liberação do estrondoso número de mais de 1.800 agrotóxicos nos últimos quatro anos (entre 2019 e 2022). E não para por aí.
Cerca de metade dos agroquímicos aprovados no Brasil não são autorizados para uso na Europa por oferecerem riscos à saúde humana e ao meio ambiente. Hoje esses produtos, comumente combinados com a utilização de sementes transgênicas, são utilizados ostensivamente nas lavouras do país, via pulverização terrestre e aérea, impactando não somente o ar, as plantações, as águas, a terra e a biodiversidade, mas povos indígenas, camponeses, quilombolas e comunidades tradicionais.
Todos esses povos - que resistem em seus territórios há séculos - lutam para sobreviver em uma verdadeira guerra química promovida pelo agronegócio e pelos grandes latifúndios de monoculturas de produção de commodities para exportação. No Cerrado este cenário é ainda mais violento: mais de 70% dos agrotóxicos utilizados no país são consumidos na região, de acordo com o estudo “Ecocídio nos Cerrados: agronegócio, espoliação das águas e contaminação por agrotóxicos”, publicado pela Universidade Federal do Paraná (UFPR).
Vivendo em territórios contaminados
É com o olhar voltado para essa conjuntura que a Campanha Nacional em Defesa do Cerrado lançará hoje, dia 30 de maio, a publicação “Vivendo em territórios contaminados: Um dossiê sobre agrotóxicos nas águas do Cerrado”. O material apresentará os resultados da “pesquisa-ação” implementada em sete territórios do Cerrado e que realizou análises toxicológicas ambientais sobre a qualidade das águas em comunidades dessas localidades.
Mariana Pontes, assessora da Campanha e uma das organizadoras da publicação, explica que o dossiê combina diferentes movimentos metodológicos. “Foram realizadas a revisão de literatura especializada sobre agrotóxicos e as análises laboratoriais, além da contribuição dos conhecimentos tradicionais das comunidades que estão, cotidianamente, enfrentando os impactos dos agrotóxicos que poluem às suas águas e envenenam os seus roçados”, explica.
Na maioria dos casos, as amostras de águas coletadas e analisadas pela pesquisa são oriundas de nascentes, córregos e rios que abastecem as comunidades, sendo utilizadas para a irrigação de plantações, consumo animal e, em algumas situações, também para o consumo humano. As comunidades que fizeram parte da pesquisa situam-se nos estados do Tocantins, Goiás, Maranhão, Piauí, Mato Grosso do Sul, Mato Grosso e Bahia, em regiões do Cerrado e de zonas de transição com a Amazônia e o Pantanal.
Os resultados apresentados no dossiê são alarmantes, aponta Mariana. “Mais de 10 tipos de agrotóxicos foram identificados nas análises de coleta de água, um dado que não nos surpreende, mas preocupa muito, uma vez que milhares de pessoas, das sete comunidades que participaram da construção da pesquisa, possuem suas vidas diretamente impactadas por estes produtos que são extremamente tóxicos para a saúde humana”, destaca a assessora.
O material é uma iniciativa da Campanha Nacional em Defesa do Cerrado e da Comissão Pastoral da Terra (CPT) em parceria com a Fundação Oswaldo Cruz (Fiocruz). A pesquisa em campo contou com o apoio de agentes da CPT de Tocantins, Goiás, Maranhão, Piauí e Mato Grosso do Sul, da Federação de Órgãos para Assistência Social e Educacional (Fase) no Mato Grosso e da Agência 10envolvimento, na Bahia.
A publicação será disponibilizada gratuitamente, em formato digital, no site da Campanha em Defesa do Cerrado a partir do dia 30 de maio.
